The U.S. Constitution and the Federal Copyright Act
give "copyright" protection to "authors" for their "original works",
such as photographs. Among the protections that copyright owners have is the exclusive right
to:

Make copies of that work;

Prepare other works based on the
original; |

Distribute copies of the work to the
public by sale, rental, lease, or lending, and

To publicly perform and display the
work |
These rights are protected by laws, which provide
for damages and criminal penalties for violations. Both customer and the lab that reprints
photographs are subject to the law.
All photographs are copyrighted as soon as the
photographer creates them.

Copyright infringement is copying a photograph
without written permission of the copyright owner. This includes copying using a photocopier,
a photographic copy, a digital copy stand or scanning into a computer.

ABSOLUTELY NOT! Copyright can only be
transferred in writing by the owner, the photographer. The sale of a print does not include
copyrights to that image. You own the print, but do not have the right to have additional
copies made by anyone other than the photographer.

No mark is required anywhere on the print. If
it looks professionally done and it is, under the law, it is copyrighted.

photographer plus 50 years.

Generally, no. It is a legal obligation for
labs to protect the photographer to the extent possible to keep you and them from incurring
liability.

A professional photographer will do their best to
see that your needs are met. If they cannot make copies, they may let you have someone else
make them. A consent form is needed from your photographer if this is the case.

Photographers spend a lot of time and creative
energy in getting the education and experience in setting the camera, pose, lighting, background and
extra shots to get the right one. The services are priced by taking into account the fact that
customers will purchase prints from the photographer. If the prints are obtained elsewhere,
the photographer loses the opportunity to recover a fee for the effort expended. Thus, the
photographer wants the customer to come to him or her to request reprints so an appropriate fee can
be charged.
Some photographers charge a realistic fee up front
to compensate for their services, whether or not prints are ordered. They may authorize the
customer to have the prints made elsewhere.
Photographers are also concerned about artistic
integrity. Since their name is associated with the photos, they want control over how the
reprints look. There may be many other reasons.
